Terms of Service

Please read these Terms carefully before using ZOMI. By checking the acceptance box, creating or accessing an account, placing an order, or otherwise using the service, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, do not use ZOMI.

1. Agreement scope, components, and acceptance

1.1 These User Terms of Service (the “Terms”) form a binding agreement between you and ZOMI Technology Ltd. (“ZOMI”, “we”, “us”, or “our”), a company registered in British Columbia, Canada.

1.2 These Terms apply when you access or use www.zomi.menu, any ZOMI mobile application, any ZOMI H5 page, and any related ordering, payment, pickup, delivery, account, support, or other user-facing service made available by ZOMI (collectively, the “ZOMI Service”).

1.3 These Terms incorporate the ZOMI Refund Policy, Privacy Policy, Modify Order Policy, and any order-specific rules, notices, fee disclosures, promotional conditions, or other policies presented to you through the ZOMI Service. Together, these documents form the entire set of rules governing your use of the ZOMI Service.

1.4 You accept these Terms by checking an acceptance box, creating or accessing a ZOMI Account, placing an order, or otherwise accessing or using the ZOMI Service. Your electronic acceptance has the same effect as a handwritten signature to the extent permitted by law.

1.5 ZOMI may retain an electronic record of the version of the Terms you accepted, the date and time of acceptance, and related account, device, or service records where reasonably necessary to administer the agreement, demonstrate acceptance, prevent fraud, or comply with law.

1.6 If you do not agree to these Terms, you must not create or use a ZOMI Account, place an order, or otherwise use the ZOMI Service.

1.7 If these Terms conflict with an order-specific disclosure or a special policy expressly identified as applying to a particular matter, the more specific disclosure or policy controls for that matter.

1.8 Nothing in these Terms excludes, restricts, or waives any guarantee, condition, remedy, or consumer right that cannot lawfully be excluded, restricted, or waived.

2. Nature of the ZOMI service and transaction relationship

2.1 ZOMI is an ordering platform that allows users to browse independent Merchants, submit pickup or delivery orders, and make payments.

2.2 Each restaurant or other business listed on ZOMI is an independent business (a “Merchant”). Merchants set their own menus, Items, prices, fees, promotions, availability, and operating hours; decide whether to accept orders; prepare and package the food or other products; and remain responsible for what they provide.

2.3 ZOMI does not cook food, own or operate the Merchants, or independently determine what a Merchant serves. ZOMI’s role is to display information made available through the platform and to transmit your order and payment information to the relevant Merchant and service providers.

2.4 When a Merchant accepts your order, the contract for the purchase and supply of the Items is between you and that Merchant. ZOMI remains responsible for the parts of the platform service that these Terms and the applicable policies expressly assign to ZOMI.

2.5 Where delivery is offered, the Delivery Service is performed by an independent third-party delivery provider and its Courier, currently DoorDash, unless a different provider is identified at checkout or in the order record.

2.6 Nothing in these Terms creates an employment, partnership, joint venture, franchise, fiduciary, or general agency relationship between ZOMI and any Merchant, Delivery Partner, or Courier.

3. Eligibility

3.1 You may use the ZOMI Service only if you have the legal capacity to enter into a binding contract and are not prohibited from using the service under applicable law.

3.2 If you are under the age of majority where you live, you may use the ZOMI Service only with the permission and supervision of a parent or legal guardian who accepts responsibility for your use and any order you place.

3.3 The ZOMI Service is not directed to children under 13. A child under 13 must not create an account, place an order, or provide personal information to ZOMI.

3.4 If you place an order for another person, you confirm that you are authorized to do so and that all recipient, contact, allergy, pickup, and delivery information you provide is accurate and complete.

4. Account registration and security

4.1 You sign in using your phone number and a one-time verification code sent by SMS. ZOMI does not use or store account passwords.

4.2 You must provide accurate, current, and complete account and contact information and promptly update it when it changes.

4.3 You are responsible for keeping your phone, SIM card, device, and SMS verification codes secure. Anyone who can receive or access your verification code may be able to sign in as you.

4.4 You are responsible for orders and other activity conducted through your ZOMI Account unless applicable law provides otherwise or you promptly report unauthorized access and ZOMI confirms that the activity was not attributable to you.

4.5 You must not sell, transfer, rent, share, or misuse a ZOMI Account, and you must not create or use multiple accounts to evade restrictions or improperly obtain promotions, refunds, or other benefits.

4.6 If you believe your account, phone number, payment method, or verification code has been compromised, contact hello@zomi.menu promptly and take reasonable steps to secure the affected device and accounts.

4.7 ZOMI may require reasonable identity, account, payment, or transaction verification before processing an order, refund, account request, or other sensitive action.

5. Merchant, menu, and product information

5.1 Merchant names, menus, Items, prices, ingredients, photographs, descriptions, portion information, availability, hours, and other Merchant content are provided or controlled by the relevant Merchant or its licensors.

5.2 Opening hours, preparation times, pickup windows, delivery estimates, availability indicators, and “open now” status may change without notice and are not guarantees.

5.3 Photographs and descriptions are provided for identification and information. The appearance, presentation, portion, packaging, ingredients, or availability of an Item may differ from the information shown, subject to applicable law and the Merchant’s obligations.

5.4 An “in-store price” or similar statement applies only where it is expressly shown and means that the displayed Item price is the same price the Merchant represents it charges at the counter. Taxes, fees, tips, delivery charges, or promotions may still differ.

5.5 A Merchant may decline an order, mark an Item as out of stock, or contact you about an unavailable Item. Any substitution, replacement, price difference, cancellation, or refund is subject to Sections 9 and 13.

6. Order submission, acceptance, and fulfillment

6.1 Submitting an order is an offer by you to purchase the selected Items from the Merchant on the terms and at the total shown at checkout.

6.2 An order is accepted only when the Merchant confirms it. An order confirmation or payment authorization generated before Merchant acceptance confirms receipt of your request but does not by itself require the Merchant to accept the order.

6.3 A Merchant may decline an order, including where an Item is unavailable, the kitchen is at capacity, the Merchant is closing, the order cannot reasonably be fulfilled, or the Merchant identifies another operational or safety issue.

6.4 After acceptance, the Merchant is responsible for preparing, packaging, and making the order available for pickup or Courier collection in accordance with the accepted order, subject to any permitted adjustment described in these Terms.

6.5 Preparation, pickup, and delivery times are estimates. Actual times may be affected by Merchant workload, Item complexity, traffic, weather, Courier availability, address access, safety conditions, and other circumstances.

6.6 You must review the Merchant, Items, quantities, options, contact information, fulfillment method, Pickup Time, Delivery Address, payment method, fees, tips, and total before submitting the order.

6.7 The order status and transaction records displayed by ZOMI may be used to administer the order and investigate a dispute, subject to correction where ZOMI identifies an error or receives reliable contrary evidence.

7. Prices, taxes, tips, fees, and promotions

7.1 Menu and Item prices are set by the Merchant. ZOMI does not independently set the Merchant’s Food Total or determine the Merchant’s in-store prices.

7.2 Applicable taxes, Packaging Fee, Packaging Tax, Service Fee, Service Fee Tax, Delivery Fee, Delivery Fee Tax, Local Courier Fee, tips, and any other charge will be identified or included in the total shown before you complete payment.

7.3 The total shown at checkout is the amount you authorize ZOMI and its payment provider to charge, subject to a later refund, reversal, or adjustment permitted by these Terms or required by law.

7.4 A Pickup Tip or Merchant Tip is paid to the Merchant in full. A Courier Tip is allocated for the applicable delivery service. Tips are voluntary unless clearly stated otherwise before payment and are refundable only as provided in Section 13.

7.5 The Merchant configures the Packaging Fee and Packaging Tax and receives those amounts in full, subject to payment processing, refunds, and applicable law.

7.6 Promotions and discounts may be offered or funded by a Merchant or ZOMI, may be subject to eligibility, time, location, Item, minimum-spend, account, or redemption conditions, and may be changed, suspended, or ended while they are not part of an already accepted order.

7.7 If an obvious pricing, tax, fee, promotion, or technical error is identified before Merchant acceptance, the order may be corrected, declined, or canceled. ZOMI will not increase the amount charged without your authorization unless applicable law permits the adjustment.

8. Payment

8.1 Payments are processed by Stripe. Available payment methods may include payment cards, Apple Pay, and Google Pay.

8.2 By completing checkout, you authorize the payment provider to charge the payment method you selected for the total shown and authorize any refund or reversal permitted under these Terms.

8.3 ZOMI does not receive or store your full payment card number. Stripe handles card data and returns a payment reference that may support transaction records or reuse of a saved payment method.

8.4 You represent that you are authorized to use the selected payment method and that the payment information is accurate.

8.5 If a payment fails, is declined, cannot be authenticated, is disputed, or is later reversed, ZOMI or the Merchant may decline or cancel the order, restrict account functions, or seek payment of an amount lawfully owed.

8.6 Your bank, card issuer, wallet provider, or payment network may apply its own terms, holds, currency conversion, or processing times. ZOMI does not control those independent services.

9. Order modifications

9.1 Once an order is placed, ZOMI sends it directly to the Merchant and, for delivery, to a Courier. From that point, almost nothing about the order can be changed through ZOMI.

9.2 ZOMI cannot modify or replace any Item in an existing order. You may contact the Merchant to request a modification or replacement, but any change arranged outside ZOMI will not be reflected on your ZOMI receipt.

9.3 ZOMI cannot modify the amount of an existing order or charge you again for that order. Any additional amount required for a change must be arranged directly between you and the Merchant, including the payment method, and will not appear on your ZOMI receipt.

9.4 ZOMI cannot modify the name, phone number, email address, or other Contact Information provided for an existing order.

9.5 You cannot change the Payment Method or make a new payment through ZOMI for an existing order.

9.6 ZOMI cannot modify the Pickup Time of an existing Instant or Scheduled Pickup Order. You may ask the Merchant for a different Pickup Time. The Merchant may adjust preparation time through the ZOMI for Restaurant App, which will update the Actual Pickup Time shown in your ZOMI order record.

9.7 The Pickup Time of an existing Instant or Scheduled Delivery Order cannot be modified. If you bypass this restriction by contacting the Merchant or Courier to force a change and the change results in an abnormal order status, ZOMI will not be responsible for issuing a refund.

9.8 The Delivery Address of an existing Instant or Scheduled Delivery Order cannot be modified. If you bypass this restriction by contacting ZOMI’s Delivery Partner or the Courier to force a change and the change results in an abnormal order status, ZOMI will not be responsible for issuing a refund.

9.9 For an Instant or Scheduled Delivery Order proceeding normally, the assigned Courier cannot be replaced at your request.

9.10 A cancellation or refund connected with an attempted order change is governed by Section 13.

10. Pickup

10.1 For a Pickup Order, you must collect the order from the correct Merchant during the Pickup Time or pickup window shown and be prepared to provide the name, phone number, or order number associated with the order.

10.2 A displayed Pickup Time is an estimate based on information from the Merchant and may be adjusted by the Merchant as permitted under Section 9.

10.3 Food that is not collected may be discarded or otherwise made unavailable for quality or safety reasons.

10.4 If you do not collect an order and the Merchant no longer keeps it available, any refund is the Merchant’s decision, as described in Section 13.

10.5 You should review the order at pickup where reasonably possible and promptly report an apparent issue to the Merchant or ZOMI according to the responsibility rules in Section 13.

11. Delivery

11.1 Where delivery is offered, the Delivery Service is performed by a third-party Delivery Partner and Courier, currently DoorDash, rather than by ZOMI or the Merchant.

11.2 You must provide a complete and accurate Delivery Address, unit or access details, recipient name, and reachable phone number before submitting the order.

11.3 You must remain reasonably available by phone and be able to receive the order at the Delivery Address. The Merchant, Delivery Partner, or Courier may contact you to complete the order.

11.4 Delivery times are estimates and may change because of Merchant preparation, Courier availability, traffic, weather, building access, safety, or other operational conditions.

11.5 If the Courier cannot reach the Delivery Address, cannot contact you, cannot gain access, or cannot find a person able to receive the order, the order may be completed, returned, canceled, or otherwise disposed of under the Delivery Partner’s procedures, and a refund may not be available.

11.6 Delivery cancellations, loss, damage, delay, non-assignment of a Courier, and other delivery-related refund requests are governed exclusively by the allocation of responsibility in Section 13.

12. Food, allergens, and safety

12.1 Menu descriptions, ingredients, allergen statements, dietary labels, preparation methods, and food-safety information displayed on ZOMI are provided by the Merchant.

12.2 Merchant kitchens may handle multiple ingredients in shared preparation, cooking, storage, and packaging areas. Cross-contact may occur even when an Item is described as free from a particular ingredient.

12.3 ZOMI does not prepare food and does not independently inspect, test, or verify the Merchant’s ingredients, allergen information, dietary claims, food handling, or regulatory compliance.

12.4 If you have a food allergy, intolerance, dietary restriction, or other health concern, contact the Merchant directly before placing the order and rely on the information the Merchant provides.

12.5 If you believe food may be unsafe, stop consuming it, preserve relevant information or evidence where appropriate, contact the Merchant, and contact the relevant health or regulatory authority when warranted.

12.6 After pickup or delivery, you are responsible for reasonable storage, handling, reheating, and consumption of the order. ZOMI is not responsible for deterioration or contamination caused by delay or improper handling after the order is handed over, except to the extent applicable law provides otherwise.

13. Cancellations and refunds

13.1 General Principles

13.1.1 Refund eligibility depends on the fulfillment method, order status, reason for the request, available evidence, and whether responsibility belongs to ZOMI, the Merchant, or a Delivery Partner.

13.1.2 Because Merchants prepare the food and set their own prices, fees, and availability, many refund decisions belong to the Merchant rather than ZOMI.

13.1.3 Where this Section assigns a refund decision to the Merchant, ZOMI will not issue a refund on the Merchant’s behalf without the Merchant’s authorization and is not responsible for the Merchant’s refusal to refund, subject to applicable law.

13.1.4 Where this Section assigns a matter to ZOMI, ZOMI may investigate and will make the final platform decision after considering available order, payment, Merchant, Courier, and user information.

13.1.5 This Section does not affect any non-waivable right or remedy available under applicable consumer protection law.

13.2 Pickup Orders - By Order Status

13.2.1 Completed normally: ZOMI will not issue a refund. If you require a refund, contact the Merchant directly.

13.2.2 Completed, but the Merchant did not prepare the order or did not keep it available for you at the Pickup Time: contact hello@zomi.menu. ZOMI will investigate and provide a final decision.

13.2.3 Canceled automatically because the Merchant did not accept the order within the required time: ZOMI will automatically issue a Full Refund.

13.2.4 Canceled by ZOMI after a risk review: ZOMI may cancel after detecting a suspected High-Risk User Account, an Unauthorized or Fraudulent Card Transaction, Abusive or Fraudulent Ordering Activity, or similar activity. Contact hello@zomi.menu regarding your circumstances. ZOMI will investigate and provide a final decision.

13.2.5 Canceled by the Merchant: ZOMI will automatically issue a Full Refund.

13.2.6 Marked as out of stock by the Merchant: marking an Item out of stock does not itself process a refund. Whether to refund an out-of-stock Item is entirely at the Merchant’s discretion. If you no longer want the remaining Items, contact the Merchant to request cancellation of the entire order.

13.2.7 Preparation delayed by the Merchant: the Merchant may extend preparation time without a fixed limit. Any Partial Refund, Full Refund, compensation, or cancellation is entirely at the Merchant’s discretion. ZOMI will not process a refund on the Merchant’s behalf without authorization and is not responsible for refunding this type of order.

13.3 Pickup Orders - Matters Handled Only by the Merchant

13.3.1 ZOMI does not issue refunds for food quality, portion size, missing or substituted ingredients, food appearance, food not matching its image, food packaging quality or damage, Food Safety Concerns, or similar issues. Contact the Merchant directly. For Food Safety Concerns, you are also advised to contact the relevant authorities.

13.3.2 ZOMI does not issue refunds for the Packaging Fee or Packaging Tax. The Merchant configures and receives those amounts in full.

13.3.3 ZOMI does not issue refunds for the Pickup Tip. The Pickup Tip is paid to the Merchant in full.

13.4 Pickup Orders - Additional Rules

13.4.1 If the Merchant cancels the entire order through the ZOMI for Restaurant App, you will receive a Full Refund as defined in Clause 13.9.1.

13.4.2 ZOMI will not cancel an entire order on the Merchant’s behalf without the Merchant’s authorization.

13.4.3 If the Merchant does not agree to refund an order, ZOMI will not independently refund the Service Fee or Service Fee Tax for that order.

13.4.4 ZOMI will not directly refund an order if you selected the wrong Merchant, Items, Pickup Time, ZOMI Account, Contact Information, or Payment Method; could not collect the order for a reason attributable to you; or made a similar user error.

13.4.5 If you fail to collect the order at the Pickup Time and the Merchant no longer keeps it available, contact the Merchant to request a refund directly.

13.4.6 If the Merchant did not prepare the order or did not keep it available for you at the Pickup Time, contact hello@zomi.menu. ZOMI will investigate and provide a final decision.

13.5 Delivery Orders - General Allocation

13.5.1 A Delivery Order may involve separate responsibilities for the Items, Merchant preparation, payment, Courier assignment, pickup, transport, and final delivery. A refund request will be assigned according to the event that caused the issue.

13.5.2 A cancellation of only the Delivery Service does not automatically cancel the Merchant order or establish a right to a refund of all order components.

13.5.3 You must cancel through the ZOMI Service where a cancellation option is available. Contacting the Delivery Partner or Courier directly does not constitute a cancellation through ZOMI.

13.6 Delivery Orders - By Order Status

13.6.1 Completed normally: ZOMI will not issue a refund. For a refund limited to the Food Total, Food Tax, Merchant Tip, Packaging Fee, Packaging Tax, or similar Merchant charges, contact the Merchant directly.

13.6.2 Exception - the Delivery Partner canceled only the Delivery Service because, for example, the Courier could not reach the pickup address or Delivery Address, or no Courier was available for an extended period: contact hello@zomi.menu. ZOMI will investigate and provide a final decision.

13.6.3 Canceled by you before the Merchant accepted the order and before a Courier was assigned: ZOMI will automatically issue a Full Refund.

13.6.4 Canceled by you outside ZOMI by contacting the Delivery Partner or Courier directly: ZOMI will not issue a refund. If you require a refund, contact the Merchant directly.

13.6.5 Canceled automatically because the Merchant did not accept within the required time: ZOMI will automatically issue a Full Refund.

13.6.6 Canceled by ZOMI after a risk review: ZOMI may cancel after detecting a suspected High-Risk User Account, an Unauthorized or Fraudulent Card Transaction, Abusive or Fraudulent Ordering Activity, or similar activity. Contact hello@zomi.menu. ZOMI will investigate and provide a final decision.

13.6.7 Canceled by the Merchant: ZOMI will automatically issue a Full Refund.

13.6.8 Exception - the Courier canceled the Delivery Service because, for example, the Merchant did not prepare the order within the required time or did not hand it to the Courier: contact the Merchant to request a refund. ZOMI will not refund on the Merchant’s behalf without authorization. If the Merchant refuses, ZOMI will not independently refund the Service Fee, Service Fee Tax, Delivery Fee, Delivery Fee Tax, Courier Tip, Local Courier Fee, or related charges.

13.6.9 Marked as out of stock by the Merchant: marking an Item out of stock does not itself process a refund. Whether to refund the Item is entirely at the Merchant’s discretion. If you no longer want the remaining Items, contact the Merchant to request cancellation of the entire order.

13.6.10 Preparation delayed by the Merchant: the Merchant may extend preparation time without a fixed limit. Any Partial Refund, Full Refund, compensation, or cancellation is entirely at the Merchant’s discretion. ZOMI will not refund on the Merchant’s behalf without authorization and is not responsible for refunding this type of order.

13.7 Delivery Orders - Matters Handled Only by the Merchant

13.7.1 ZOMI does not issue refunds for food quality, portion size, missing or substituted ingredients, food appearance, food not matching its image, food packaging quality or damage, Food Safety Concerns, or similar issues. Contact the Merchant directly. For Food Safety Concerns, contact the relevant authorities where appropriate.

13.7.2 ZOMI does not issue refunds for the Packaging Fee or Packaging Tax. The Merchant configures and receives those amounts in full.

13.7.3 ZOMI does not issue refunds for the Merchant Tip. The Merchant Tip is paid to the Merchant in full.

13.7.4 ZOMI does not issue refunds where the Courier cancels the Delivery Service because the Merchant did not prepare the order or did not prepare it within the required time. Contact the Merchant directly.

13.8 Delivery Orders - Matters Handled by ZOMI

13.8.1 ZOMI handles a refund request where the entire order or part of the order was lost for Delivery-Related Reasons.

13.8.2 ZOMI handles a refund request where the entire order or part of the order was damaged for Delivery-Related Reasons.

13.8.3 ZOMI handles a refund request where the order was delayed by more than 30 minutes after the Courier picked it up.

13.8.4 ZOMI handles a refund request where no Courier was assigned for an extended period, including where no Courier was available in the area.

13.8.5 If the Merchant did not prepare the order or did not keep it available until the designated time for Courier pickup, contact hello@zomi.menu. ZOMI will investigate and provide a final decision.

13.9 Full Refund Components, Refund Method, and Timing

13.9.1 For a Pickup Order, a Full Refund includes the Food Total, Food Tax, Pickup Tip, Packaging Fee, Packaging Tax, Service Fee, and Service Fee Tax.

13.9.2 For a Delivery Order, a Full Refund includes the Food Total, Food Tax, Merchant Tip, Packaging Fee, Packaging Tax, Service Fee, Service Fee Tax, Delivery Fee, Delivery Fee Tax, Courier Tip, and Local Courier Fee.

13.9.3 A refund issued by ZOMI will be returned to the original Payment Method unless applicable law requires another method. ZOMI cannot redirect the refund to a different card, wallet, or account merely because the original method is no longer convenient.

13.9.4 ZOMI’s records may show when a refund is initiated, but the time required for the credit to appear is controlled by Stripe, the payment network, your bank, card issuer, or wallet provider. Their processing time is not controlled by ZOMI.

13.9.5 A Partial Refund covers only the amount approved for the affected Item or charge. Fees, taxes, or tips will not be refunded unless the approving party or applicable law expressly includes them.

13.10 Refund Requests, Evidence, and Contact

13.10.1 For any matter this Section assigns to ZOMI, contact hello@zomi.menu and provide the phone number linked to your ZOMI Account, order number, Merchant name, a clear description of the issue, and any reasonably available photographs, messages, receipts, or other supporting information.

13.10.2 ZOMI may verify a request using platform records and information from the Merchant, Delivery Partner, Courier, Stripe, or other relevant service provider.

13.10.3 You must provide truthful and complete information. Duplicate, altered, misleading, abusive, or fraudulent refund requests may be denied and may result in the measures described in Section 17.

13.10.4 Where a refund decision belongs to the Merchant, contacting ZOMI does not transfer that decision to ZOMI. ZOMI may facilitate communication but is not required to fund the Merchant’s refund obligation without authorization or a legal requirement.

13.10.5 No refund will be issued directly by ZOMI for a Delivery Order if you selected the wrong Merchant, Items, Pickup Time, ZOMI Account, Contact Information, Delivery Address, or Payment Method; could not receive the order for a reason attributable to you; or made a similar user error.

14. Privacy and personal information

14.1 Scope and Responsibility

14.1.1 ZOMI Technology Ltd. operates the ZOMI website and mobile applications and is responsible for the personal information ZOMI collects and controls through the ZOMI Service.

14.1.2 A Merchant is an independent business. When you place an order, the Merchant receives the information needed to prepare and hand over the order and handles that information under its own privacy practices and legal obligations.

14.1.3 For a privacy question or to exercise a right described in this Section, contact hello@zomi.menu or write to ZOMI Technology Ltd., 450 SW Marine Dr, Vancouver, BC, Canada.

14.2 Information We Collect

14.2.1 Account Information: your phone number, the name you provide, one-time SMS verification activity, account status, and related security records. ZOMI does not use or store passwords.

14.2.2 Order Information: the Merchant and Items ordered, quantities, options, notes, pickup or delivery time, order status, amounts, refunds, and order history.

14.2.3 Payment Information: Stripe processes card and wallet payments. ZOMI does not receive or store your full card number. ZOMI retains the payment reference returned by Stripe, together with the amount, currency, and transaction result.

14.2.4 Delivery Information: your delivery address, recipient and access details, and delivery contact information, collected when you place a Delivery Order.

14.2.5 Device and Usage Information: randomly generated client and session identifiers, pages and Merchants viewed, language preference, and standard server log data such as IP address, browser type, and timestamps.

14.2.6 Support Information: the content of emails and other messages you send to ZOMI and information you provide in connection with an order, refund, privacy, safety, or account request.

14.3 Location, Cookies, and Local Storage

14.3.1 ZOMI uses location only if you select “Use current location” and grant permission, or if you type an address.

14.3.2 For restaurant distance and re-ordering, ZOMI itself does not receive your precise position. The calculations occur in your browser, and the coordinates are stored only in your browser’s local storage, are not sent to ZOMI’s servers, and are not placed in a cookie.

14.3.3 ZOMI derives the coarse city used to serve you, such as “Vancouver”. That city is stored in the zomi-hub-city cookie and is visible to ZOMI’s servers.

14.3.4 If you use current location, your coordinates are sent to Google so Google can return the place name displayed to you, such as a street address when sufficiently precise or a broader area when less precise. If you type an address, the text is sent to Google for suggestions and the coordinates returned by Google remain in your browser. Google handles those requests under its own privacy policy.

14.3.5 ZOMI uses the zomi-biz-token cookie to keep you signed in, zomi-hub-city to remember the city list, zomi-biz-subdomain to remember the Merchant being viewed, zomi-biz-lang to remember language, and zomi-biz-client-id and zomi-biz-session-id as random identifiers used to measure service use.

14.3.6 Browser local storage may hold saved location coordinates, recently viewed Merchants, and interface preferences. You may clear cookies and local storage at any time, but signing in or using the service will recreate the items required for operation.

14.4 Purposes of Use

14.4.1 ZOMI uses personal information to create and secure your account, confirm sign-in, and provide account functions.

14.4.2 ZOMI uses personal information to transmit and fulfill orders, arrange pickup or delivery, process payment, issue refunds where due, and maintain transaction records.

14.4.3 ZOMI uses personal information to answer questions, provide support, communicate order status, and investigate disputes.

14.4.4 ZOMI uses personal information to detect, prevent, and investigate fraud, abuse, unauthorized payments, safety events, and technical problems.

14.4.5 ZOMI uses device and usage information to understand how the service is used, maintain performance, diagnose errors, and improve features.

14.4.6 ZOMI uses and retains information as necessary to comply with legal, tax, accounting, regulatory, payment-network, and dispute-resolution obligations.

14.5 Consent and Choices

14.5.1 ZOMI relies on your consent for the collection, use, and disclosure described in this Section, subject to other authority permitted or required by applicable law.

14.5.2 You may withdraw consent at any time by contacting hello@zomi.menu. Withdrawal does not invalidate processing already completed and may prevent ZOMI from providing account, ordering, payment, delivery, or support functions that require the information.

14.5.3 You may decline location permission and manually enter an address or browse by city, subject to the features available in the service.

14.6 Sharing of Personal Information

14.6.1 Merchant: ZOMI shares your name, phone number, order details, notes, and fulfillment information so the Merchant can prepare the order, hand it over, and contact you about it.

14.6.2 Stripe: ZOMI shares or transmits information needed to process card, Apple Pay, and Google Pay transactions and handle refunds.

14.6.3 DoorDash or another identified Delivery Partner: for Delivery Orders, ZOMI shares your name, phone number, Delivery Address, access details, and order information needed to complete delivery.

14.6.4 Google: Google Maps provides map views, Google Places provides address autocomplete, and Google Geocoding converts coordinates you share into a place name. Google handles those requests under its own privacy policy.

14.6.5 SMS Provider: ZOMI shares your phone number and related delivery information as needed to send sign-in verification codes and permitted service messages.

14.6.6 Service Providers: hosting, storage, error-monitoring, analytics, communications, security, and professional service providers may process information on ZOMI’s instructions and may not use it for their own independent purposes except as permitted by law.

14.6.7 Legal and Safety: ZOMI may disclose information where required by law or legal process or where reasonably necessary to protect the rights, safety, security, or property of ZOMI, users, Merchants, Couriers, service providers, or the public.

14.6.8 Business Transfers: information may be transferred in connection with a proposed or completed merger, acquisition, financing, reorganization, or sale of assets, subject to applicable law.

14.7 No Sale or Independent Advertising Use

14.7.1 ZOMI does not sell your personal information.

14.7.2 ZOMI does not provide your personal information to advertisers for their own independent marketing.

14.8 Retention

14.8.1 ZOMI retains account and order records while your account is active and afterwards for as long as required for tax, accounting, legal, fraud-prevention, and dispute-resolution purposes.

14.8.2 Order and payment records are retained for at least six years. Device and usage records are retained for a shorter period appropriate to their purpose.

14.8.3 When information is no longer required, ZOMI deletes it or renders it anonymous, subject to backups, legal holds, and technically reasonable deletion cycles.

14.9 Your Rights and Complaints

14.9.1 You may request access to a copy of personal information ZOMI holds about you, request correction, withdraw consent, or request account closure and deletion, subject to lawful retention requirements and exceptions.

14.9.2 Send a request to hello@zomi.menu. ZOMI may verify your identity before acting and will respond within 30 days as required by applicable Canadian privacy law, unless an authorized extension applies.

14.9.3 If you are not satisfied with ZOMI’s response, you may complain to the Office of the Privacy Commissioner of Canada or, depending on where you live, the Office of the Information and Privacy Commissioner for British Columbia or Alberta.

14.10 Information Security

14.10.1 Information transmitted between your device and ZOMI is encrypted in transit.

14.10.2 ZOMI limits internal access to personal information to personnel who need access for their work.

14.10.3 Payment card data is handled by Stripe, a payment provider that meets PCI-DSS requirements, and does not pass through ZOMI’s systems.

14.10.4 No transmission or storage method can guarantee absolute security. ZOMI therefore cannot guarantee that personal information will never be subject to a security incident.

14.11 Cross-Border Processing

14.11.1 ZOMI operates in Canada. Some service providers, including Stripe and Google, may process information in the United States.

14.11.2 When information is processed in another country or region, it may be accessible to courts, law-enforcement bodies, or national-security authorities in that jurisdiction under local law.

14.12 Children’s Personal Information

14.12.1 The ZOMI Service is not directed to children under 13, and ZOMI does not knowingly collect personal information from children under 13.

14.12.2 If you believe a child under 13 has provided personal information to ZOMI, contact hello@zomi.menu. ZOMI will take steps to delete the information.

15. Service communications

15.1 ZOMI will send a one-time sign-in verification code to the phone number you provide. Your mobile carrier may charge message or data fees according to your plan.

15.2 To complete an order, ZOMI, the Merchant, the Delivery Partner, or the Courier may contact you by telephone, SMS, email, push notification, or the order interface.

15.3 Order confirmations, status updates, security alerts, refund notices, and service-change notices are transactional or operational communications related to your use of the ZOMI Service.

15.4 Marketing messages will be sent only where ZOMI has the consent required by applicable law. Stopping marketing messages does not prevent you from receiving sign-in, order-status, safety, security, or other transactional communications.

15.5 You agree to receive these Terms, order confirmations, receipts, policy updates, and other documents and notices related to the ZOMI Service electronically.

16. User conduct

16.1 You must not scrape, crawl, or bulk-copy the ZOMI Service or platform content.

16.2 You must not use bots, scripts, or other automated means to submit orders.

16.3 You must not interfere with service operation, probe for vulnerabilities, exploit a system weakness, or attempt to access an account, order, or data that is not yours.

16.4 You must not impersonate another person or submit an order that you do not intend to pay for, receive, or collect.

16.5 You must not use an unauthorized or fraudulent payment method or misuse a refund, chargeback, promotion, coupon, or discount.

16.6 You must not harass, threaten, discriminate against, or harm a Merchant, Courier, other user, or ZOMI personnel.

16.7 You must not use ZOMI for any unlawful activity.

17. Risk review and account measures

17.1 To protect users, Merchants, Couriers, and the payment system, ZOMI may investigate a suspected High-Risk User Account, Unauthorized or Fraudulent Payment, fraudulent transaction, abnormal order, promotion abuse, or other abusive activity.

17.2 During an investigation, ZOMI may cancel an order, suspend payment or refund processing, restrict account functions, or require reasonable identity or transaction information.

17.3 ZOMI may suspend or close an account that seriously or repeatedly violates these Terms.

17.4 Because of security, fraud, legal, or payment-network requirements, ZOMI may be unable to disclose specific risk-detection methods or all investigation information.

18. Intellectual property

18.1 The ZOMI name, marks, software, website, applications, interfaces, designs, databases, and related technology belong to ZOMI or its licensors.

18.2 Merchant names, marks, menus, photographs, and product content belong to the relevant Merchant or its licensors.

18.3 Subject to your compliance with these Terms, ZOMI grants you a limited, personal, non-exclusive, non-transferable, and revocable license to access and use the ZOMI Service only for its normal intended purpose.

18.4 Without authorization from the relevant rights holder, you may not copy, sell, rent, sublicense, modify, reverse engineer, extract, or otherwise exploit the ZOMI Service or platform content, except where applicable law expressly permits it.

19. Third-party services

19.1 ZOMI relies on Stripe, Google Maps, Google Places, Google Geocoding, DoorDash, SMS providers, hosting providers, and other third parties to provide parts of the ZOMI Service.

19.2 Your use of a third-party service may be governed by that third party’s own terms and privacy policy.

19.3 ZOMI cannot fully control the continued availability, processing time, or specific conduct of a third-party service.

19.4 The ZOMI Service may contain links to third-party websites or services. A link does not mean that ZOMI endorses or guarantees the third party’s content, goods, or services.

20. Service availability and changes

20.1 The ZOMI Service is provided on an “as is” and “as available” basis.

20.2 ZOMI will use commercially reasonable measures to maintain the service but does not guarantee that it will always be uninterrupted, secure, timely, or error-free.

20.3 ZOMI may add, modify, suspend, or discontinue features; conduct maintenance or upgrades; adjust supported cities, Merchants, or delivery areas; and replace third-party service providers.

20.4 An order already accepted by a Merchant will be handled under these Terms and the applicable order-specific policies.

21. Account closure

21.1 You may request account closure by contacting hello@zomi.menu.

21.2 Account closure does not affect any order, payment, refund, chargeback, dispute, or other legal responsibility arising before closure.

21.3 After account closure, ZOMI may retain records required for legal, tax, accounting, fraud-prevention, and dispute-resolution purposes in accordance with Clause 14.8.

22. Disclaimers

22.1 To the extent permitted by applicable law, ZOMI does not independently warrant food or products prepared or supplied by a Merchant.

22.2 ZOMI does not guarantee that Merchant-provided menus, photographs, ingredients, allergens, operating hours, or availability information will always be complete and accurate.

22.3 ZOMI does not guarantee that a Merchant will accept an order or that an estimated preparation, pickup, or delivery time will be met.

22.4 ZOMI is not responsible for consequences caused by inaccurate address, contact, order-option, pickup-time, or payment information that you provide.

22.5 These Terms do not exclude or limit any warranty, condition, obligation, or consumer right that cannot be excluded or limited under applicable law.

23. Limitation of liability

23.1 To the fullest extent permitted by applicable law, ZOMI is not liable for indirect, incidental, special, punitive, exemplary, or consequential loss arising from or related to the ZOMI Service or an order.

23.2 To the fullest extent permitted by applicable law, ZOMI’s aggregate liability in connection with a particular order is limited to the amount you actually paid for that order.

23.3 The limitations above do not apply to liability that cannot lawfully be excluded or limited, including non-excludable consumer-protection liability.

24. Governing law and dispute resolution

24.1 These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there.

24.2 The courts of British Columbia have jurisdiction over related disputes, but this does not deprive you of any right under applicable consumer protection law to bring a claim where you live.

24.3 If an order or service dispute occurs, you may first contact hello@zomi.menu and provide the account phone number, order number, Merchant name, description of the issue, and relevant evidence so ZOMI can investigate.

25. Updates to these terms

25.1 ZOMI may update these Terms because of service changes, legal requirements, security risks, or operational needs.

25.2 The current version will display its latest update date.

25.3 If a change materially affects your rights or obligations, ZOMI will provide more prominent notice through the website, application, email, SMS, or another reasonable method and will request renewed confirmation where required by law.

25.4 Continuing to use ZOMI after an update takes effect means that you accept the updated Terms. If you do not agree, stop using the service and you may request account closure.

25.5 An order already submitted and accepted by a Merchant is generally governed by the order rules in effect when it was submitted, unless applicable law requires otherwise.

26. Miscellaneous

26.1 If any part of these Terms is held invalid, illegal, or unenforceable, the remaining parts remain in effect.

26.2 ZOMI’s failure to immediately enforce a right under these Terms does not waive that right.

26.3 You may not transfer your ZOMI Account or your rights under these Terms without ZOMI’s written consent.

26.4 ZOMI may transfer these Terms to an affiliate or as part of a merger, financing, reorganization, asset sale, or transfer of business.

26.5 Clauses that by their nature should continue, including provisions concerning payment, refunds, privacy, intellectual property, disclaimers, limitation of liability, and dispute resolution, survive account closure or termination of use.
